What Personal Data is collected and why?

Personal data collected in the context of grant applications
The Data Controller may need to collect Personal Data in the context of a grant application by the Data Subject. The provision of this Personal Data is mandatory to enable the Data Controller to contact the Data Subject again.

Purposes and legal basis: The processing of this Personal Data is necessary to enable the Data Controller to obtain the information necessary for the constitution and management of a grant application. The processing is based on the legitimate interests of the Data Controller for the purpose of carrying out its activity and, where applicable, the performance of a pre-contractual relationship. If the Personal Data is not provided, the Data Subject will not be able to interact with the Data Controller.

Personal data collected for partnership monitoring

The Data Controller may collect Personal Data in the context of monitoring projects and partnerships.

In particular, photographs, audio or video recordings taken in the context of the implementation of the projects and showing persons connected with the project may be collected by the Fonds de Dotation, either through grant recipients or directly, by virtue of a contract for the transfer of image rights.

Purposes and legal basis: The processing of this Personal Data is necessary for the Data Controller to comply with its contractual and legal obligations, i.e. the management of the contractual relationship with the Data Subject, in particular accounting management, payment management, and any exchange with the Data Subject. It also allows the constitution and management of a contact file in connection with its sponsorship activity and communication or canvassing operations with the Person Concerned. The processing is based on the performance of the pre-contractual or contractual relationship between the Data Controller and the Data Subject, the compliance of the Data Controller with its legal obligations and the legitimate interests of the Data Controller for the purpose of carrying out its activity.

Data collected in the context of processing a request relating to a right conferred by the RGPD

The Controller may collect Personal Data when the Data Subject exercises a right relating to his/her Personal Data with the Controller.

Purposes and legal basis: The processing of this data is necessary to fulfil the Company’s legal obligations. In compliance with the purposes set out above, the Data Subject’s Personal Data may be communicated to the Data Processor’s staff in charge of managing requests.

How is personal data processed?

The Personal Data are subject to computer processing by the Fonds de Dotation for the purposes set out above. The Fonds de Dotation undertakes not to use them in any other context, nor to transmit them to third parties, except as provided for below or with the express consent of the Person Concerned.

Recipients: in accordance with the purposes set out above, Personal Data may be communicated to the staff, companies of the Compagnie Fruitière group and suppliers and service providers of the Fonds de Dotation, in particular in the context of IT, publishing, printing or reprography services.

The Fonds de Dotation may also be required to disclose Personal Data in order to comply with a legal obligation, at the request of a judicial or public authority, or pursuant to a judicial or administrative decision or an independent administrative authority.

In the event of transmission of Personal Data to a third party in the capacity of Data Controller, the Data Subject acknowledges that the processing of his/her Personal Data is carried out by such third parties, under their responsibility and according to their own personal data protection policy, in their capacity as Data Controller.

In case of transmission of Personal Data to a third party having the quality of Subcontractor, the Fonds de Dotation shall take all measures to require from these third parties the compliance with the applicable regulations and, if necessary, that the transfers are based on an adequate level of protection or sufficient guarantees. Third parties qualified as Subcontractors are authorized to process Personal Data only on the instructions of the Fonds de Dotation.

Retention and archiving :

The Personal Data are kept for a period of 3 years from the end of the relationship between the Fonds de Dotation and the Person Concerned, if any, or from the last contact from the Person Concerned, for the purpose of managing its contact file and, if necessary, to recontact the Person Concerned.

The Images and, if applicable, the personal data relating to the image rights transfer act are kept for a period of 5 years from their collection by the Fonds de Dotation for the purpose of illustrating the subsidized projects and the action of the Fonds de Dotation, during the contract period.

The Personal Data are archived for a maximum period of 5 years from the date of the end of the contractual relationship between the Fonds de Dotation and the Person Concerned or from the last contact from the Person Concerned, which period is necessary for the establishment, exercise or defense of a legal right (prescription period).

The Fonds de Dotation makes its best efforts to keep and archive these Personal Data in appropriate security conditions in compliance with the applicable provisions, according to the current technical means.

What rights do I have to the Personal Data I provide?

Any person having communicated Personal Data to the Fonds de Dotation has the following rights over them:

  • A right to erasure of data (“right to be forgotten”), a right to restrict processing and a right to object to processing in the cases provided for by the regulations in force;
  • A right of access and rectification;

  • The right to set out instructions on what to do with one’s personal data after death;
  • A right to portability of raw data provided to Compagnie Fruitière ;

These rights may be exercised by e-mail to rgpd@fruitiere.fr or by post to the registered office of the Data Controller.

These rights must be exercised in accordance with the conditions set out in the regulations in force. In particular, a copy of the applicant’s identity document may be requested in order to prove his or her identity to Compagnie Fruitière, in order to prevent any unauthorized access to the Personal Data concerned.
